Consumer rights

The consumer's right of withdrawal is regulated by the Regulation on Distance Contracts Implementation Procedures and Principles, and the said article is as follows:

Right of Withdrawal

Article 8 - Consumer; In distance contracts for the sale of goods, the customer has the right to withdraw from the contract by rejecting the goods within seven days from the date of receipt, without assuming any legal or criminal liability and without giving any reason. In distance contracts for service provision, this period starts on the date the contract is signed. If it is agreed in the contract that the service will be performed before the 7-day period expires, the consumer may exercise his right of withdrawal until the date on which the performance begins. Expenses arising from the exercise of the right of withdrawal belong to the seller or provider.

Contracts regarding services performed instantly in the electronic environment and goods delivered instantly to the consumer are not subject to the provisions regarding the right of withdrawal and its use.

Even if the delivery of the goods is made to a person other than the consumer who is a party to the contract, the consumer can exercise his right of withdrawal. In this case, the seller receives the goods from the third party in accordance with the provision of the fourth paragraph of Article 9.

The consumer cannot exercise his right of withdrawal for goods produced in accordance with the consumer's special wishes and demands or personalized by making changes or additions. In addition, the consumer cannot exercise his right of withdrawal in the case of goods that cannot be returned due to their nature and are likely to deteriorate rapidly or expire.

If the seller or supplier does not fulfill its obligations specified in Article 6 or Article 7, the seller or provider shall correct the deficiency within thirty days at the latest. In this case, the seven-day period starts from the date on which the consumer is informed in writing that the deficiency in question has been corrected. Otherwise, the consumer is not bound by a seven-day period to exercise his right of withdrawal.

If the price paid by the consumer is partially or completely covered by the seller or provider or based on an agreement between the seller or provider and the creditor, in case the right of withdrawal is exercised, the credit contract terminates automatically, without the obligation to pay any compensation or penalty amount. However, for this, the notice of withdrawal must be sent to the lender in writing.
